Terms and Entry Agreement

By entering the Premises located at 1110 Shop Road, you agree to the terms on this page. If you do not agree to the terms on this page DO NOT ENTER THE Premises.

WAIVER, GENERAL RELEASE OF LIABILITY, AND INDEMNITY

For and in consideration of the privilege of access to, participation in or attendance of events at, and/or use of the premises located at 1110 Shop Road, Columbia, South Carolina 29201 (the “Premises”), in connection with one or more events occurring at the Premises, including, without limitation, any one or more of the following: tailgating before, during, and after any and/or all University of South Carolina 2025 home football games, or any other event occurring at the Premises organized, managed, and/or promoted by either Fraternity Lot Leasing 2025, LLC or FiveFest LLC, including in each case any entry on the Premises before or after such event, for set up, clean up, or for any other reason (each, an “Event”, and collectively, the “Events”):

I, the undersigned, agree that there are inherent risks associated with the Events, my participation in the Events is voluntary, and I and hereby assume any and all risks associated with the Events, including the risk of my injury or death. I hereby agree for myself, and my heirs, personal representatives, executors and assigns, forever to release, discharge and hold harmless Dirt Lot Holdings, LLC, Spartan Parking Enterprises, LLC, Spratlin Game Day LLC, Fraternity Lot Leasing 2025, LLC, FiveFest LLC and their respective parent companies, subsidiaries, and affiliates, and the shareholders, members, directors, managers, and officers of, and anyone directly or indirectly employed, contracted, or engaged by, any of them or for whose acts they may be liable (collectively, the “Released Parties”), from any and all liability for injury or damages of any and every kind whatsoever that I may sustain from or related to my participation in the Events, including unforeseen and unanticipated injuries and damages, and including injuries or damages caused by negligent acts or omissions of the  Released Parties or others.

I agree to participate in the Events in a safe and legal manner and in accordance with all applicable laws and regulations, including without limitation laws related to use of drugs and alcohol, any rules provided by any of the Released Parties, and all other terms and conditions herein or otherwise applicable to me in connection with the Events (collectively, the “Applicable Laws and Rules”). If I am also signing below as parent or guardian of an attendee or participant at one or more of the Events who is under the age of 18 (a “Minor”), I shall be responsible for the compliance of the Minor with the Applicable Laws and Rules. In addition, if the rules applicable to the Event permit me to bring a guest, I shall be responsible for the compliance of my guest with the Applicable Laws and Rules. I will defend, indemnify, and hold harmless the Released Parties for any violation or breach of the Applicable Laws and Rules by me, my guest, or any such Minor.

I understand, acknowledge, and agree that upon purchasing the right to enter the premises, such right is personal to me and is strictly non-transferable and non-assignable. Any attempt by another individual to access the premises using my right of entry shall constitute a violation of the terms and conditions applicable to me.

By signing below, I acknowledge and represent that (i) I have the authority to enter into this Waiver, General Release of Liability, and Indemnity (this “Release”) on behalf of myself (and my guest, if applicable) or as a parent or guardian; (ii) I agree to the terms and conditions described herein; (iii) I have read and fully understand this Release; and (iv) I agree to be bound by its terms, and understand that the Released Parties are relying on this Release as a condition to and requirement for granting my access to the Premises.
